Supreme court Stays Rahul Gandhi’s Conviction in Defamation Case : File Photo

New Delhi : The Supreme Court has given an important verdict on the petition for suspension of sentence awarded to Congress leader Rahul Gandhi in the Modi surname case. The apex Court has stayed the sentence awarded to Rahul Gandhi. The stay of sentence will remain in force, till the appeal is pending. Along with this order of the court, the membership of Rahul Gandhi’s Parliament has also been restored. Now they will be able to participate in the Parliament session as well.

A Surat court had earlier found him guilty and awarde him the maximum sentence of two years’ imprisonment – leading to his disqualification from the Lok Sabha. The Gujarat high court had refused to stay the conviction, after which Gandhi had appealed in the Supreme Court.

The Supreme Court said that Rahul Gandhi’s remarks were not in good taste. His statement was not correct. One should be careful on this in public life. At the same time, the court said that the lower court did not make it clear in its order that why the maximum punishment was needed? The judge should have explained the reason for the maximum sentence. This case comes in non-cognizable category. The Supreme Court said that both the courts wrote pages on a large scale, but why Rahul Gandhi was given maximum punishment, this aspect was not considered.

With this decision of the Supreme Court, the doors of Parliament have been legally opened for Rahul Gandhi. Constitution expert Advocate Rajiv Mishra Said that that with the decision of the Supreme Court, Rahul’s disqualification has ended. If elections been held for the Wayanad seat after Rahul was disqualified as a member of Parliament, his membership would not have been restored. By-elections have not yet been held in Wayanad. Hence the issuance of the order for restoration of membership from the Lok Sabha Secretariat is just a formality.
